These General Terms and Conditions govern the legal framework for the use of the Discord bot “Ice-Elf” as well as the associated online services (including, but not limited to, the web dashboard, APIs, bot functions, and premium modules).
Ice-Elf is provided by a private individual with residence in Switzerland. It is a privately operated project without a formal corporate structure. The complete contact details can be found in the Legal Notice. The billing of chargeable services (premium functions) is properly handled via the payment service provider Stripe. All taxes and value-added taxes arising in connection with the use are collected and paid insofar as legally required. The use of the bot as well as the associated systems takes place voluntarily and under the acknowledgement of these General Terms and Conditions by the respective administrator or owner of a Discord guild on which the bot is installed.
These General Terms and Conditions apply worldwide regardless of the geographical location of the use and are binding for all users who activate, configure, or use the bot via the dashboard. They govern in particular the legal framework of the bot usage, questions of data protection, disclaimers of liability, as well as the handling of chargeable premium services.
By installing or actively using the bot and the provided services, you accept these General Terms and Conditions in their respective current version. It is recommended to check these General Terms and Conditions regularly, in particular when new functions are introduced or when there are changes in the legal situation.
By inviting the Discord bot Ice-Elf into a Discord guild or by using functions via the dashboard, the API, or other system components, you agree to these General Terms and Conditions as well as to the Privacy Policy.
These General Terms and Conditions apply to all content, functions, and services in connection with the use of Ice-Elf, regardless of which technical platform or interface is used for access. This includes in particular, but not limited to:
It is the sole responsibility of the respective users or administrators to ensure that the use of Ice-Elf is legally permissible in their country or region. The provider assumes no liability for violations of applicable law outside of Switzerland.
The provider is entitled to change or supplement these General Terms and Conditions at any time – in particular in the case of technical developments, new functions, legal adjustments, or organizational changes to the offer.
The respective current version is permanently available at https://ice-elf.ch and is deemed binding upon its publication. By continuing to use Ice-Elf after the updated General Terms and Conditions have come into effect, all users automatically acknowledge these as binding.
It is the responsibility of the users to regularly inform themselves about the applicable version of these General Terms and Conditions as well as the associated Privacy Policy.

Ice-Elf does not act as an agent or service provider of the Discord platform (available at https://discord.com) and/or its owner(s) or representative(s).
You declare and guarantee that you are legally capable and authorized to enter into these General Terms and Conditions and to comply with all obligations and regulations contained therein.
You confirm that you are authorized under the laws of your country to use Ice-Elf and to interact with its functions.
You bear sole responsibility for the lawful use of Ice-Elf in your jurisdiction and expressly release the provider from any liability in connection with violations of local, national, or international regulations.
The use of Ice-Elf – both in the free basic version and within the framework of a premium subscription – takes place exclusively within the scope of a simple, non-transferable right of use (“license”) that can be revoked by the provider at any time.
In particular, in the event of violations of these General Terms and Conditions, in the event of security risks, or in the event of misuse, the provider reserves the right to terminate or restrict this right of use with immediate effect – even without prior notice or compensation.
As a user, you receive access to the functions provided via Ice-Elf – in the form deemed appropriate by Ice-Elf in each case, using the available technical means and interfaces.
You expressly acknowledge that any fees incurred apply to the general access to these functions. The specific design of individual functions can change at any time and lies solely at the discretion of the provider.
Ice-Elf offers a variety of functions for the management and automation of Discord guilds. The provided features may change, be supplemented, or be removed over time. The following functions are currently provided (not exhaustive):
There is no entitlement to specific content, technical details, functionality, or permanent availability of individual functions. Changes, extensions, or restrictions of individual functions do not entitle the user to refunds or claims for compensation.
For access to certain functions – in particular the dashboard or the configuration of guild-specific settings – a login with a valid Discord account is required.
The registration takes place exclusively via the official OAuth2 login of Discord. In doing so, Ice Elf is authorized by Discord to access the basic data released by the user (e.g., guild affiliation, username, avatar). Discord passwords are neither stored nor processed.
By logging in, you declare that all transmitted information is correct, current, and lawful. The use of third-party, falsified, or manipulated accounts is prohibited. In the event of a justified suspicion of misuse, access to individual functions can be blocked or permanently withdrawn.
Access to editing a guild is only possible for Discord users who have sufficient rights (at least administrator rights) within the respective guild. Ice-Elf automatically checks with each request whether the corresponding permissions are present. Without valid rights, functions will not be executed.
Some functions of Ice-Elf can also be used without dashboard access – for example, via bot commands directly in Discord. However, the use of the dashboard is recommended for extended configuration options.
Users are themselves responsible for the security of their Discord account. The provider assumes no liability for damages resulting from unauthorized access or misuse.
In the context of providing Ice-Elf, non-personal information is also processed – in particular, such information that relates to the respective Discord guild. These data are used exclusively for the purpose of providing technical functionality. Depending on the function, these data may be stored for a short period (e.g., in the cache) or for a long period (e.g., in the database), provided that this is necessary for the proper operation.
As soon as this information is no longer required – for example, through deactivation of the function or removal of the bot from the respective guild – the associated data will be deleted promptly in order to comply with the principle of data minimization.
In the context of using certain functions, it may be necessary to technically process personal data such as the Discord user ID for a short period.
This processing takes place exclusively for the immediate execution of the respective function. Storage for a longer period only takes place if it is required for the technical function – and in this case exclusively in encrypted form and for a limited period.
The provision of personal data is neither legally nor contractually required. However, certain functions of the bot are technically only possible if certain data are processed temporarily. If such processing is refused, the respective functions cannot be used.
In addition, the administrators of each Discord guild have full control via the Discord-specific rights management over which permissions are granted to or withdrawn from the bot. This allows detailed control over whether the bot, for example, may read messages, display members, or manage roles.
Premium is a digital immediate service that is provided immediately after purchase. By purchasing and activating Premium, you expressly agree that we will begin the execution of the contract before the expiry of the statutory withdrawal period and confirm that your right of withdrawal thereby expires.
A statutory right of withdrawal for consumers in the EU therefore does not exist once the Premium service has been actively used or activated.
By making the payment, you expressly agree that the contract will be fulfilled immediately and that your right of withdrawal expires. The use of the Premium functions takes place voluntarily, at your own risk, and without any legal obligation for reversal.
Billing is carried out via the payment service provider Stripe within the framework of a monthly subscription. The subscription can be cancelled at any time and – unless cancelled – is automatically renewed by Stripe. The cancellation takes effect at the end of the current subscription period. All legally required fees, taxes, and charges are automatically taken into account and paid.
Each user is assigned a unique Stripe customer ID (Customer-ID), which is linked to their Discord user ID. The email address used during purchase must be clearly associated with the individual user. This is the only way to ensure proper display and management of multiple subscriptions within the Stripe customer portal.
If multiple subscriptions are created using the same email address but different user IDs or payment details, this may lead to limitations or issues in subscription management. The provider assumes no liability in such cases.
Premium subscriptions enable users to regularly access extended functions of Ice-Elf. A paid subscription begins upon receipt of payment by the provider.
The subscription applies exclusively to the Discord guild for which it was concluded. A transfer to other guilds or a global use of the premium status across multiple Discord servers is not possible.
To maintain the subscription, the respective fee due must be paid on time. Otherwise, access to the premium functions may be restricted or terminated.
With the activation of premium functions, the user receives a simple, non-transferable right of use (license) for the respective Discord guild. This right automatically expires upon the expiration or cancellation of the subscription.
A fixed-term subscription begins upon receipt of payment and runs for the period chosen by the user. After expiration, access to the premium functions ends automatically unless the subscription is renewed.
An early cancellation is only possible in accordance with these General Terms and Conditions. Refunds for periods that have already begun are excluded.
Subscriptions are automatically renewed using the payment method selected at the time of purchase (e.g. via Stripe), unless they are timely cancelled by the user. The renewed term corresponds to the originally chosen term. This also applies after the expiry of a free trial period (e.g. a free month), a promotion, or a discounted introductory period. If, at the time of purchase via Stripe, a valid payment method was stored, the subscription will automatically convert at the end of the trial or promotional period into a paid, recurring subscription and will be charged to the payment method used at the time of purchase, unless the user cancels before expiry.
The provider may at any time and without liability block, restrict, or terminate access to functions, in particular if:
In the event of blocking, restriction, or termination by Ice-Elf due to a violation of these General Terms and Conditions, there is no entitlement to compensation, refund, or damages.
The user can cancel the subscription at any time. Access to premium functions and the license remains in effect until the end of the paid term.
There is no entitlement to a refund – even in the event of early cancellation or non-use. In particular, a violation of the General Terms and Conditions or the inaccuracy of user data does not entitle the user to early termination with a refund.
Upon the termination becoming effective, the right of use ends. Access to premium functions is deactivated, and all associated license rights expire. A refund – for any chosen term – is excluded.
A complete and immediate deletion of all stored data relating to a Discord user or a Discord guild can be requested explicitly via the Ice-Elf community support. This concerns in particular configuration data, premium assignments, as well as technically stored guild-related settings.
Alternatively, all stored data will be automatically and promptly deleted when the bot is removed from a guild, provided that there are no legal or security-related retention obligations to the contrary.
Please note that such deletion may permanently restrict future access to certain functions or histories. A refund of payments already made is not possible under any circumstances.
The premium function is provided without any guarantee of availability, error-free operation, or uninterrupted service.
Despite the utmost care, outages, functional restrictions, or technical problems may occur at any time – even with an active premium status.
Premium guilds as well as non-premium guilds have no entitlement to a fully functioning system. A refund of premium periods already paid is generally excluded – even in the event of temporary or complete unavailability of individual functions.
Likewise, there is no entitlement to compensation, rectification, or warranty – regardless of the cause. The provider reserves the right to apply goodwill arrangements in individual cases – however, without legal obligation.
Users have the possibility to join the official Ice-Elf community Discord server. There, general questions can be asked, or support tickets can be opened. Additionally, there is the possibility to send anonymous feedback via the dashboard.
The ticket system is available as a voluntary community tool, without any entitlement to individual processing or technical resolution.
Support requests via the community server are processed manually and according to availability. There is no entitlement to an immediate response, a fixed response time, or an obligation to provide a resolution. Guild- or user-related topics are handled exclusively via the ticket system of the community server.
By using Ice-Elf – whether in the free or paid version – you receive a simple, non-exclusive, non transferable, and revocable at any time right of use for utilizing the provided functions, exclusively within the framework of these General Terms and Conditions.
This right of use does not include the source code, nor the structure, organization, or other protected components of the system. There is no entitlement to access, duplicate, or distribute the code, the configuration, or the underlying architecture.
The use of Ice-Elf is permitted exclusively within the scope of the intended functions and via the official platforms of the provider (e.g., Discord bot, web interface, API).
The use, duplication, or integration of individual functions, modules, or visual elements into external systems – in particular outside the Ice-Elf platform – is prohibited. This applies in particular to the export, reuse, or integration into other services, bots, websites, or software solutions.
It is also not permitted to replicate the design, structure, interaction logic, or graphic elements of Ice-Elf or to use them as part of other software products, unless there is an explicit written permission from the provider.
All rights to the source code, structure, technical implementation, as well as to all contents and design elements (including, but not limited to, texts, designs, names, logos, layouts, UI/UX components, stylesheets, icons, graphics, avatars, and API specifications) remain exclusively with the provider.
This also applies to specifically developed representations, layout proposals, or visual simulations within Discord, provided they have been designed specifically for Ice-Elf.
The use of Ice-Elf does not transfer any ownership or exploitation rights. The software as well as the entire provided system – including the web interface and all associated visual, functional, and technical components – is provided solely for use. There is neither a sale nor a license grant or any other transfer of ownership.
Any form of duplication, reproduction, publication, modification, decompilation, redistribution, or circumvention of technical protective measures is prohibited. This explicitly also applies to imitations of Ice-Elf-specific elements, avatars, or functional flows. The protection also extends to future developments or extensions of the platform.
Note: For the visualization of guild layouts or bot processes, Ice-Elf partially uses visual elements that are based on the user interface of Discord. These serve exclusively for illustration purposes and are in no way connected with Discord Inc.
Insofar as users introduce content (e.g., texts for welcome messages, configurations, or emoji setups) into the system, the rights to this content remain with the respective user.
However, by uploading or inserting, you agree that the provider may technically store, process, and display this content within the framework of the bot’s functionality. There is no transfer, publication, or commercial use by the provider outside of this functionality.
By submitting feedback, ideas, or suggestions – for example, via the dashboard, the community server, or other provided channels – you expressly agree that your submissions may be processed and used free of charge and without any claim to participation, compensation, or attribution.
There is no legal entitlement to participation, compensation, or recognition – even if your suggestion is fully or partially incorporated into a later function. All further developments of Ice-Elf take place independently and without obligation towards individual users.
The use of Ice-Elf does not transfer any additional rights – in particular, not to intellectual property, platform components, or brand identifiers. All rights not expressly granted in these General Terms and Conditions remain with the provider.
The use of Ice-Elf takes place entirely at the own responsibility of the respective Discord guilds and their administrators. The service is provided “as is” and without any guarantee or assurance – in particular, not for availability, scope of functions, compatibility, or error-free operation. The provider assumes no direct or indirect liability for material or immaterial damages, in particular not for:
Ice-Elf is provided as a voluntary, privately operated service without a commercial structure. There is expressly no entitlement to compensation, refunds, rectification, or subsequent improvement – also not in connection with paid premium functions. The provision takes place without obligation, and any use is at the user’s own risk.
Despite technical protective measures and a security-conscious system setup (e.g., through permission checks, API checks, access control, etc.), complete protection against data loss, misuse, or external interference cannot be guaranteed.
Ice-Elf is offered worldwide. It is the sole responsibility of the users to ensure that the use of the bot is legally permissible in their country or region. The provider assumes no liability for violations of local, national, or international regulations, in particular not in cases of:
The use takes place entirely at the user’s own risk, and the provider is not liable for regional usage conflicts, legal violations, or resulting claims by third parties.
In the event of legal disputes in connection with Ice-Elf, the provider does not assume any court, attorney, or other procedural costs – regardless of the outcome or reason for the proceedings.
Should a user file a lawsuit against the provider, the user undertakes to fully bear all costs incurred in the course of the provider’s legal defense – including attorney, court, expert, and incidental costs, even in the event of a settlement or closure of the proceedings.
Any liability of the provider for direct or indirect damages, lost profits, consequential costs, or expenses is fully excluded – regardless of the legal basis. Should, despite this disclaimer of liability, a judicial liability of the provider be established, the amount of liability is strictly limited to the amounts paid by the user for paid premium services in the six months prior to the initiation of the proceedings. There is no further liability for damages, losses, loss of revenue, or legal costs.
Should, despite this disclaimer of liability, a liability of the provider be established, the provider is liable exclusively for damages caused by gross negligence or intent.
Exclusively the substantive law of the state in which the provider has their residence (Switzerland) applies, excluding international private law and foreign legal systems.
The place of jurisdiction is the ordinary court at the residence of the provider. By using Ice-Elf, all users expressly accept this regulation. Legal action in another location, in another state, or under another legal system is – as far as legally permissible – excluded.
The provider is entitled to transfer all rights and obligations arising from this contractual relationship to third parties, for example in the context of a restructuring, project transfer, or technical reorientation.
A transfer or assignment of rights and obligations by users is only permitted with the prior written consent of the provider.
These General Terms and Conditions have been prepared in German and are binding. Translations serve solely for comprehension. In the event of a dispute, only the German version shall be binding.
Official notifications and information in connection with Ice-Elf may be made via email, Discord message, website announcement, or via the official community server. Notifications are considered delivered as soon as they have been published or sent via one of these channels.
Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall be deemed agreed upon that comes as close as possible to the economic purpose of the invalid provision.
